In order to divorce legally in the state of Georgia, you must file a petition (called a “complaint”) in the superior court of the county in which your spouse lives (there are also residency requirements). Fees for this service apply, except in certain “family violence” cases. You must prove grounds for divorce and complete a domestic intake worksheet including information on the marriage, including assets, debts, present living arrangements and number of children still at home (if applicable). If you have children, you will be required to attend a transition workshop.

Child support, alimony, marital property and debt conflicts are decided at final trial, which will include presentation of all evidence and arguments, including witnesses, if need be. The wife’s maiden or former name can also be reinstated if she wishes.
