Dealing with false allegations of family violence

True cases of child abuse should be dealt with by law enforcement and the criminal courts. However, not all allegations of family violence are true. Allegations of abuse could arise in contentious child custody battles when one party believes that such accusations will bolster his or her position in court. Georgia residents who have reason to believe that they could face false accusations of child abuse should take steps to protect themselves.

First, try not to be alone with the children if possible. The more unbiased the witness can be, the better off you will be. Avoid behaviors and activities that could be misconstrued such as rough-housing, making inappropriate comments and even bathing the children, along with other activities. Do not blame the children if they appear to support any allegations made by the other parent since they are vulnerable to suggestion.

Attempt to maintain a positive relationship with the children. Try to find a way to resolve child custody issues amicably instead of battling the issues out in court. The more adversarial the process becomes, the more likely that the other parent may resort to unseemly tactics such as accusing you of child abuse. Strive to maintain an even attitude and avoid becoming angry in the presence of law enforcement or child services personnel.
