Filing For Divorce in Cumming GA

When you are ready to consider filing for divorce in Atlanta, call the Teiger Law Firm for prompt, accurate information and guidance on how best to protect your rights and assets.

Filing For Divorce Cumming (Plaintiff)

In order to divorce legally in the state of Georgia, you must file a petition (called a “complaint”) in the superior court of the county in which your spouse lives (there are also residency requirements). Fees for this service apply, except in certain "family violence" cases. You must prove grounds for divorce and complete a domestic intake worksheet including information on the marriage including: assets, debts, present living arrangements, and number of children still at home (if applicable). If you have children, you will be required to attend a transition workshop.

Alpharetta Filing For Divorce: Call Our Attorneys.

Around Alpharetta or Roswell, when filing for divorce or responding to divorce as a defendant, call the Teiger Law Center. We will guide you through the maze of depositions, interviews, and requests for documentation of financial claims. Our team of financial experts, including accountants and actuaries, know what to ask for and how to spot discrepancies. We will advise you as to the automatic domestic standing orders applicable to the county in which you file. These orders change from county to county, but can include prohibiting insurance coverage changes/termination, disposal of property or even interfering with the minor children, in some cases.

A settlement agreement will be presented to the court for a final judgment and decree. If an agreement cannot be reached, a judge or jury will decide (visitation and custody of the children is decided by a judge only). Divorcing spouses who can settle their dissolution without the aid of an outside decision can avoid court altogether and obtain a decree in a little over a month.

Filing for Divorce in Roswell, Cumming or Alpharetta?

Contested divorces, of course, take longer. Child support, alimony, marital property and debt conflicts are decided at final trial, which will include presentation of all evidence and arguments, including witnesses, if need be. The wife's maiden or former name can also be reinstated if she wishes. From temporary hearing to final decree, our lawyers are here to advise you on all aspects of your Alpharetta or Cumming area divorce filing. Contact us for a free consultation. The Teiger Law Center provides services throughout metro Atlanta, Fulton, Forsyth, Gwinnett, Hall and Cherokee counties.
